We have amended the clause slightly so that it allows the claimant to claim in writing and allows the insurance companies, if they have to make inquiries, to do so within 90 days. However, on specialized insurance like aviation, they should apply to the Insurance Regulatory Authority to give them more time. That was a sensible further amendment. I was pleased to see that the Committee was able to see the way forward and agree partly with the insurance companies, although we are very particular that should not be misused by the insurance companies. As the Chairman of the Committee and the Leader of the Majority Party has said, this Bill seeks to update the principal Act, Cap. 487; which is very old. Insurance companies in Kenya are very few. Therefore, they have been monopolising the insurance business. Only lately, there have been other insurance companies that have been coming up. However, many of those companies that have come up have gone under because they have not been properly constituted, and have not been able to serve the requirements of the insurance business.

In 2008, when there was violence and other things in Kisumu, certain insurance companies decided that they would not meet the claims that arose from that situation. Hon. Temporary Deputy Speaker, I have a problem with Clause 9, which suggests that the Insurance Regulatory Authority should make an assessment of the management of insurance businesses. That is very good. However, insurance companies keep on insisting that they want to be self-regulatory. They say that their operational policies should be their decision. During that time, if a Minister dared to ask for one month, we would bite his head off. Nowadays, some Committee Chairpersons request for three days, others request for one month while others request for two months.
